These Terms of Service (“Terms”) govern the relationship between Cozy Cards (“Cozy Cards,” “we,” “our,” or “us”) and the individual or entity (“Customer,” “you,” or “your”) using or accessing our services, including but not limited to the Cozy Cards Discord bot, any associated automation or integrations, APIs, web properties, and any other tools or materials provided by Cozy Cards (collectively, the “Services”). These Terms explain your rights and obligations when using the Services, including your responsibilities, subscription and payment terms, intellectual property rights, limitations of liability, dispute resolution, rate limiting, and other important topics. Our Privacy Policy outlines how we collect, store, and use your data. Please carefully review these Terms, our Privacy Policy, and any additional guidelines or documentation provided as part of the Services (collectively, the “Agreement”). By accessing or using the Services in any way, including via Discord, our website, APIs, or automated imports, you agree to be bound by this Agreement. This Agreement is effective as of the moment you first use or access the Services (the “Effective Date”). We may update these Terms periodically, and your continued use of the Services after any such changes constitutes your acceptance of the updated Terms. If you do not agree with any part of this Agreement, you must immediately stop using the Services.
1. Service Availability and Quality
Cozy Cards is a constantly evolving service. We may modify or discontinue features at any time without notice, including (but not limited to) features, algorithms, user interface elements, and data delivery formats. We do not guarantee uninterrupted availability, performance, or stability of the services. You should not build dependencies on specific service behaviors, data formats, or uptime expectations. All services are provided on an “AS IS” basis, without warranties or guarantees of any kind, express or implied. This includes, but is not limited to, any implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement. You alone are responsible for determining the appropriateness of using our services or redistributing information obtained from them. We are not liable for any losses or damages resulting from your use of the services. We reserve the right to suspend or terminate your access to Cozy Cards at any time, for any reason or no reason, without prior notice. You may not: Use Cozy Cards to develop or promote competing products or services. Reverse-engineer, probe, or extract algorithms, data, or proprietary logic from Cozy Cards. Use automated tools to scrape, generate excessive load, or mass-interact with the service. Resell or redistribute access to the Cozy Cards platform. Operate more than one Cozy Cards account per individual user. We reserve the right to investigate suspected violations and take appropriate actions. This may include reporting to legal authorities, regulators. We may disclose relevant information such as Discord user IDs, timestamps, command histories, or other operational logs as deemed appropriate under applicable law.
2. Account and Access
Access to the Services requires a Discord account. Your use of the Services is tied to your Discord user ID. You are responsible for safeguarding your Discord account and any actions taken using the Services on your behalf.
3. Eligibility
You must be at least 13 years old to use the Services. By using the Services, you represent that you meet this requirement.
4. Data Use and Privacy
Cozy Cards collects only the information necessary to operate, maintain, and improve our Services.
We collect: • Your Discord user ID and username to personalize and link your collection. • Guild (server) IDs and channel IDs to deliver bot interactions. • Your self-reported tax bracket (optional, for tax estimation features). • Data for price alerts, such as target condition and target price. • Collection and transaction data (e.g., product names, set names, card numbers, conditions, quantities, purchase prices, acquisition dates, PSA certification numbers, sale dates and prices, marketplace platforms, shipping costs, marketplace fees, tags, notes, and target prices).
We do not collect: • IP addresses • Device metadata • Geographic location
User-defined fields (tags, notes, target prices) are restricted in length to maintain system performance and prevent abuse. Data is stored securely and retained only as long as technically feasible for operating the Services or until deleted at your request.
You can delete your data anytime using the /collection-delete-everything command or by contacting us at legal@cozycards.gg. Payment-related data deletion should be handled through Stripe. Our privacy policy can be found here.
5. Error and Usage Logging
We log command usage and associated metadata (e.g., timestamps, parameters) to detect errors, improve services, and prevent abuse. This includes both internal logging on our bot server and audit logging stored in our database. Logs are not shared externally.
6. User Responsibilities
You agree to use the Services in accordance with all applicable laws and regulations. You are responsible for all activity conducted under your account. You must not: • Use the Services in a way that disrupts or interferes with its normal operation. • Attempt to circumvent security or authentication mechanisms. • Use the Services for any purpose that violates the intellectual property rights of others.
You are also responsible for maintaining the confidentiality of your account credentials and for any activities conducted using your account.
7. Third-Party Services
The Services may rely on or integrate with third-party platforms and APIs, such as Discord, Stripe, PSA, and eBay. Your use of these third-party services is subject to their respective terms and conditions. We are not responsible for the availability, accuracy, or performance of these third-party services.
You acknowledge that your use of certain features—such as payment processing, PSA certification verification, PSA population, and market data—depends on continued access to these third-party APIs. Should access to such services be modified or revoked, we are not responsible for any resulting limitations in functionality.

8. Payments and Subscriptions
All payments for premium features are processed securely through Stripe. By subscribing, you authorize recurring charges according to your selected plan. We do not store payment information ourselves, but you may access and manage your billing preferences and subscription through the Stripe-provided customer portal.
No refunds are provided except where required by law. We reserve the right to change our subscription plans and pricing at any time. Continued use of the Services after pricing changes indicates your acceptance of the new terms.
Your access to premium features is contingent upon successful and timely payment. Failure to maintain an active subscription may result in the loss of access to certain features.
If you wish to cancel your subscription, you may do so at any time via the customer portal. Canceling your subscription will prevent future charges, but you will retain access to premium features until the end of your current billing cycle.

9. Intellectual Property and Third-Party Content
All card names, set names, and images are the intellectual property of their respective owners: Pokémon is owned by The Pokémon Company International. Magic: The Gathering is owned by Wizards of the Coast. Yu-Gi-Oh! is owned by Konami.
Use of these assets falls under fair use, fan content policies, or specific license agreements. We do not claim ownership of these assets. Some features (such as PSA certification image verification) use commercially licensed data and may be monetized under terms with PSA.
10. DMCA and Takedown Policy
Notification Procedures
We respect the intellectual property rights of others. If you believe that material located on or linked to by the Service violates your copyright or trademark, please send a notice of claimed infringement by email to legal@cozycards.ggwith the subject “Takedown Request”, and include the following: • Your physical or electronic signature; • Identification of the copyrighted work (or mark) you believe to have been infringed or a representative list; • Identification of the material you believe to be infringing in sufficient detail to allow us to locate it; • Adequate contact information (name, address, phone number, and email); • A statement that you have a good faith belief the use is not authorized; • A statement that the information is accurate and, under penalty of perjury, you are authorized to act on behalf of the owner.
Upon receiving a valid takedown notice, we may remove or disable access to the material. Misrepresenting content as infringing may result in liability for damages under 17 U.S.C. §512(f).
11. Dispute Resolution and Governing Law
In the event a dispute, controversy, or claim arises out of or relating to these Terms (“Dispute”), the Dispute will be resolved by binding arbitration rather than in court. The parties will first try in good faith to settle any Dispute within 30 days after the Dispute arises. If the Dispute is not resolved within 30 days, it shall be resolved by binding arbitration by the American Arbitration Association’s International Centre for Dispute Resolution in accordance with its Expedited Commercial Rules in force as of the date of this Agreement ("Rules"). The parties will mutually select one arbitrator. The arbitration will be conducted in English in Johnson County, Kansas, USA. By agreeing to mandatory arbitration as set forth herein, You and Cozy Cards knowingly and irrevocably waive any right to trial by jury in any action, proceeding, or counterclaim, except that either party may apply to any competent court for injunctive relief necessary to protect its rights pending resolution of the arbitration. The arbitrator may order equitable or injunctive relief consistent with the remedies and limitations in the Agreement. The arbitral award will be final and binding on the parties and its execution may be presented in any competent court, including any court with jurisdiction over either party or any of its property.
Each party will bear its own lawyers’ and experts’ fees and expenses, regardless of the arbitrator’s final decision regarding the Dispute.
12. Limitation of Liability
The Services are provided "as is" and "as available." We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose. We are not liable for indirect, incidental, or consequential damages, including data loss or service interruptions. Our total liability will not exceed the amount you paid us in the twelve (12) months preceding the incident giving rise to the claim.
13. Affiliate Disclosure
Cozy Cards participates in the eBay Partner Network and may earn affiliate revenue when users click on eBay links and make qualifying purchases.
14. Miscellaneous
1. Force Majeure. Neither party will be liable for failure or delay in performance to the extent caused by circumstances beyond its reasonable control, including acts of God, natural disasters, terrorism, riots, or war. 2. No Agency. This Agreement does not create any agency, partnership, or joint venture between the parties. 3. Severability. If any part of this Agreement is invalid, illegal, or unenforceable, the rest of the Agreement will remain in effect. 4. No Third-Party Beneficiaries. This Agreement does not confer any benefits on any third party unless it expressly states that it does. 5. Survival. The sections and obligations in this Agreement that a reasonable person would expect to survive this agreement, will. 6. Governing Law. This Agreement shall be governed by the laws of the State of Kansas, USA, without reference to conflict of law rules. All disputes will be governed by the arbitration agreement above.
